ARROYO LAGO RESIDENTIAL PROJECT
ADDENDUM

128 FCS
Https://adecinnovations.sharepoint.com/sites/PublicationsSite/Shared Documents/Publications/Client (PN-JN)/2148/21480036/Addendum/21480036 Arroyo Lago Residential Project Addendum.docx
would be reduced accordingly, would adhere to all applicable federal, State, and local laws and
regulations while utilizing hazardous materials for construction. This would include, but not be limited
to, requiring compliance with Pleasanton General Plan Public Safety Element Policy 16 (“Regulate
the transportation, delivery, use, and storage of hazardous materials within the city limits”) and Policy
17 (“Ensure that hazardous materials are not released as a result of construction activities and that
any existing hazardous materials and potential contamination are remediated prior to development”).
Therefore, the proposed project would not introduce new significant impacts or create substantially
more severe significant impacts than those previously identified in the Prior FEIR. No additional
analysis is required.
d) Hazardous Materials Sites
Would the project: Be located on a site which is included on a list of hazardous
materials sites compiled pursuant to Government Code Section
65962.5 and, as a result, would it create a significant hazard to the
public or the environment?
Prior FEIR Conclusions
The Prior FEIR determined that the project site is located on a list of hazardous materials sites (the
Cortese List). The Cleanup Program Site at the project site is currently open and is undergoing long-
term management as of 2026. Long-term management refers to ACDEH’s continued oversight of the
project site until it verifies that all soil import, restoration, and reporting requirements are fully satisfied
and the case can be formally closed. The ACDEH has concluded that potential environmental impacts
from former mining operations have been adequately investigated and delineated and found not to
present an adverse risk to human health or the environment.
The Prior FEIR found that construction activities associated with the County Project could expose
contaminants to workers, the public, or the environment if not properly managed. Compliance with
COA HAZ-4a through COA HAZ-4e established by ACDEH and all applicable laws and regulations
associated with development on hazardous materials sites would reduce any potential impact
associated with the project site being located on a site included on the Cortese List. Additionally, the
County Project would be subject to ongoing regulatory requirements. Therefore, the Prior FEIR
concluded that impacts would be less than significant. (Draft EIR, pp. 3.8-21, 6-16).
Proposed Project Analysis and Conclusion
The hazardous materials conditions of the project site and related analysis identified in the Prior FEIR
for the County Project would apply to the proposed project as well. Because the project site is located
on the Cortese List, the proposed project would be required to comply with COA HAZ-4a through
COA HAZ-4e from ACDEH, which include coordinating with ACDEH prior to and during site
development by submitting the soil management protocols, project schedule, soil import
documentation, stockpile information, and soil excavation report. With the implementation of these
COAs, as well as applicable provisions of the Pleasanton General Plan, as noted above, the
proposed project would have less than significant impacts, consistent with the analysis and impact
conclusions in the Prior FEIR. Therefore, the proposed project would not introduce new significant
