Inclusionary Zoning Ordinance (IZO) and Affordable Housing
Per PMC Section 17.44.040(A), the IZO applies to all new residential for-sale and rental
projects, including mixed residential and non-residential projects, consisting of 10 or more
residential units or parcels. As such, the IZO does not apply to the proposed four-unit
residential project; however, the project must pay affordable housing fees pursuant to the
City’s Master Fee Schedule.

Analysis of the project's conformance to the standards and key policies reflected in the
General Plan, Downtown Specific Plan, PMC and ODS is provided in the Discussion section
below.

PROJECT DESCRIPTION
The applicant proposes: a Planned Unit Development (PUD) Rezoning to rezone the subject
parcel from MU-T (Mixed Use-Transitional) District to PUD-MU-T (Planned Unit Development-
Mixed Use-Transitional) District; a Certificate of Appropriateness to demolish an existing
6,160-square-foot commercial office building in the Downtown Revitalization District; and a
PUD Development Plan to construct a three-story, four-unit, residential building consisting
of three studio units (Units A, B, and C), each approximately 430 square feet, and one larger
unit (Unit D), approximately 13,626 square feet, occupying portions of all three floors.

The project also includes approximately 6,192 square feet of pervious landscaping, including
two new street trees along Old Bernal Avenue. An arborist report identified 34 trees on site, of
which 12 are recommended for removal due to project-related impacts. In addition, the
applicant seeks to use the provisions of Assembly Bill (AB) 2097, which limits the City's ability
to impose minimum parking requirements for qualifying projects located within one-half mile of
a major transit stop.

Architectural & Building Design
The proposed building incorporates a modern farmhouse architectural style, combining
traditional residential design elements with contemporary detailing. The design features
gabled roof forms, vertical board-and-batten siding, brick veneer accents, and a black
standing-seam metal roof. Additional architectural details include black-framed doors and
windows, as well as black-painted guardrails serving the rear second-floor balcony.

The proposed building is designed with a three-story west elevation, with a maximum height of
34 feet, in which the third floor is recessed from the lower levels. While the upper-floor setback
provides some variation in the building's massing, the first and second floors remain largely
aligned to a single plane, with relatively little additional articulation. The project also includes
an attached two-car garage, a rear-facing balcony of approximately 681 square feet, and a
230-square-foot second-floor terrace. Refer to Attachment 2, Exhibit B, for complete
architectural plans and project details.

Site Layout, Pedestrian and Vehicular Access
The proposed building’s rear elevation is oriented to the primary frontage along Old Bernal
Avenue with a nine-foot front setback and no primary entrance. The project would provide all
vehicle and pedestrian access to the large primary residential unit from the rear of the site via
the driveway on Augustine Street.
