PC Resolution No. PC-2026-26 September 23, 2026
40. VINEYARD AVENUE SPECIFIC PLAN
a. Section IV.E (page 48) discusses an Agricultural Mitigation Fee. This fee
is included in the City’s Master Fee Schedule. The fee compensates for
the loss of cultivable soils defined as net acreage less than 25% slope lost
to development. The applicant shall provide an exhibit that illustrates the
site areas with slopes less than 25% together with a calculation of lost
acreage. The area where the home on Parcel D is located together with
the existing driveway can be excluded since the home predates the
adoption of the Specific Plan. This fee is payable at final map approval.
b. Section IV.F.3.h (Page 51) reads, “Improvements proposed to be placed
on slopes greater than ten percent or within ten feet of the tops of such
slopes shall be approved for construction by a California licensed
Geotechnical Engineer or California certified Engineering Geologist. The
City shall approve grading plans and slope designs prior to
implementation.” Since the homes proposed for Parcels A, B, and C fit
this criteria, the applicant’s geotechnical engineer must approve the
grading design.
c. Section V.C.4 (Page 62) reads, “Private hillside streets are planned to
provide access to individual lots generally in the steeper portions of the Plan
Area... No parking is allowed.” R26(CA) “No Parking Anytime” regulatory
signs shall be installed at 200-foot intervals along all private roads within the
subdivision.
d. Section VI.B.1 (Page 75) reads, “Water connections at different elevations
require different strategies to meet established pressure criteria. Between
Elevation 390 and 475: Service connections within this band will also
experience pressures exceeding 80 psi, and will therefore require the
installation of PRV’s [pressure reducing valves]”. The elevation of Parcels
A, B, and C are within this elevation range and require PRVs to be
installed.
e. Section VIII (Page 90) discusses infrastructure financing. The City
subsequently established a fee program to reimburse the infrastructure
costs associated with development of the Specific Plan area. For equity
among property owners, the program calculated a pro-rata share to be paid
upon subdivision of property for either existing or new homes. The original
pro-rata share calculation included reimbursement for the specific plan
preparation costs. However, according to Section VIII.B.6 (Page 109) the
specific plan preparation cost ended fifteen years after plan adoption or 6-
01-2014. As such, the applicant’s pro-rata share is as follows (payable at
final map approval):

New home pro-rata fee ($68,518/unit = 3 units x $68,518) = $205,554
Discount for specific plan preparation* (($1,079) x 3 units)= <$3,237>
Specific Plan Pro-rata fee = $TBD
*Any property owner who has not filed a final subdivision map within this 15-
year period will not be obligated to pay the Fee.
Docusign Envelope ID: A549EA74-ED4F-8CB2-8262-A310230CC465
