PC Resolution No. PC-2026-26 September 23, 2026
(Adress this condition prior to plan approval).

41. VESTING TENTATIVE PARCEL MAP 11223
a. As part of the Tract 7815 (301 M 5) subdivision that abuts VTPM 11223 to
the south, the City vacated 18’ of right-of-way but reserved a public services
easement along the west side of Old Vineyard Avenue (east side of the
subdivision boundary). This was accomplished by a document recorded as
2007-303900 on 8-17-2007 pursuant to City Council Resolution No. 07-095.
For consistency, VTPM 11223 shall do the same. An appropriate note shall
be added to the plans to reflect this.
b. Private drainage rights should be conveyed upon subdivision of the
property since historic drainage patterns will now cross internal parcel lines.
The applicant shall propose how these rights will be memorialized either
through a private agreement between owners or easements (blanket or
otherwise) granted on the final map or by separate instrument. The
agreement or easements shall also address maintenance responsibilities
and obligations related to erosion or sloughing from one parcel to another.
(Adress this condition prior to map approval).

42. OLD VINEYARD AVENUE TRAIL. The Old Vineyard Avenue right-of-way was
converted to a Class 1 multi-use trail by the City in 2017. The trail includes (west
to east) a variable width earthen drainage swale, an 8’-wide aggregate base
equestrian path, a 12’-wide HMA pedestrian/bicycle path, and a shoulder. If any
portion of the bioretention area is located within the City’s right-of-way (assumed to
be 50’-wide after the vacation), then the applicant will be required to enter into a
Maintenance and License Agreement with the City for use of the area. The future
owners of the parcels shall maintain all private features in the City’s right-of-way,
and shall indemnify the City from any claims associated with the use. (Address
this condition prior to plan approval)

43. STORM DRAINAGE: The subdivision relies on a network of proposed and
existing ditches and pipes to convey stormwater to the receiving creek north of
Thiessen Street.
a. Erosive flow velocity: Some of the discharge pipes have steep slopes that
may encourage erosive flow velocities at the pipe exits. The design
includes features such as “T”-dissipators and rip-rap aprons, but supporting
hydraulic calculations and rip-rap sizing details will be needed to assure that
energy is dissipated within the system before flowing into or across erodible
surfaces. Alternatively, the earth swale proposed along the Old Vineyard
Avenue trail could be converted into a concrete ditch.
b. Referring to Section 2 and 4 on Sheet C4 of the VTM, the grade that
extends from the top of the retaining walls slopes up steeply. This slope will
allow stormwater to flow over the top of retaining walls and onto the private
road. A drainage system behind the retaining wall shall be installed to
capture and convey storm runoff.
Docusign Envelope ID: A549EA74-ED4F-8CB2-8262-A310230CC465
