constructed with better quality construction material, the sound proofing of our house
is of good quality. Therefore, the proposed Large Daycare will not create
disturbance to the neighbors. "

CONCERNS/PROBLEMS:
In the time that 5276 Genovesio Drive has been operating the daycare, the care
provider often allows the children to play in the backyard. This has caused
significant noise pollution to the once peaceful and subdued environment of Valencia.
Often times you can hear the children crying, yelling, and playing.

Noise-In the past, the neighborhood has enjoyed a peaceful and intimate community
with about 9.4+/- feet of space in between each house. That is too little space to
buffer noise from the daycare. Since the inside of the house is small, the daycare will
extend its space into the backyard. There are several backyard neighbors who
directly share backyard fencing. The applicant states that "our house is separated by
large back yards", which most believe are relatively small at about 4 7x20 feet in
length and width. The back yards are not large enough to buffer the noise generated
by 14 children at playtime.

Crowding- The pool area, basketball area and playground are already over-crowded,
particularly during the summer season when children are out of school. The residents
complain at board meetings about not being able to use the amenities because of the
long waiting lines. The addition of more children will further intensify the current
problem. The daycare children's "outdoor playtime" will intensify the crowding and
make it more difficult for actual residents to enjoy the amenities for which they
should be entitled.

CURRENT VACANCY AT DA YCARES WITIDN 2 MILE RADIUS

According to the yellow pages and the City of Pleasanton, there are 22 daycares within a
2-mile radius of the applicant site (EXHIBIT G-Current Daycares). The nearest facility
is 0.5 miles away, inside the Hacienda Business Park. This demonstrates that there is not
a lack of facilities available to the people of the Hacienda Business Park or within the 2
mile surrounding area of Pleasanton. Further, upon calling these daycares, there are
many vacancies among the 22 facilities. So, granting this Large Family Daycare will add
more vacancies to the already existing daycares. The approval of this daycare does not
benefit the existing daycares, in fact it will hurt them. Not only will it hurt the existing
daycares, but it puts extreme burdens on the neighborhood of Valencia.

On May 4, 2005, a Board meeting for the HOA was held and the daycare was a topic of
discussion. The applicants of the daycare were present and so were about 50+ neighbors.
The neighbors openly expressed their opposition ofthe daycare because of the burdens it
brings to the neighborhood in terms of parking, traffic, and speeding, etc. The applicant
attempted to mitigate these issues with offering to talk to the parents to ensure they don't
speed. The neighbors were not convinced that this would be adhered to. In addition the
applicant could not mitigate the other problems which the neighbors presented (ie parking
and traffic). The applicant also went as far as saying that they were operating this
daycare "... for society..." in an attempt to solicit compassion from the neighbors. The
