situations. In this case, the developer was able to tailor the development standards and
guidelines to the unique situations presented by hillside terrain, the desire to preserve and
protect natural open space, and the desire to limit the amount and type of grading which
can occur with individual lots. Staff feels that the development standards and guidelines
as proposed and conditioned can accomplish such goals.

Staff feels that the proposed development plan takes into account the City's desire to
preserve open space and significant vegetation and to reduce grading on hillsides. The
developer is proposing to limit the size of the building envelopes and preclude
development in the remaining open space. The PUD process also allows for ample input
from the public and for an ultimate decision by the City Council regarding
appropriateness of the proposed use and development plan.

Stafffeels that through the PUD process the proposed project has provided the developer
and the City with a development plan that optimizes the use of this hillside site in a
sensitive manner. Therefore, staff believes that this finding can be made.

VII. CONCLUSION

The subject site is sensitive due to its location on a hillside with many existing trees. Stafffee1s
that the proposed plan is appropriate in density and design for this site and conforms to the
Vineyard A venue Corridor Specific Plan. As conditioned, staff feels that the proposed
development plan and design guidelines address the types of issues and concerns that staff
normally has regarding hillside development. Therefore, staff is requesting that the Commission
recommend approval of the proposed development plan.

VIII. ENVIRONMENTAL ASSESSMENT

Environmental review for the proposed project was undertaken with the Final Environmental
Impact Report (EIR) approved by the City Council for the Vineyard Avenue Corridor Specific
Plan in conformance with the standards of the California Environmental Quality Act (CEQA).
There are no substantial changes to the project or to the circumstances under which the project is
being undertaken that involve new significant environmental effects or that substantially
increase the severity of previously identified effects.

However, the proposed access road alignment has been modified by moving the entry from the
existing road alignment of Lot 25 from the easterly boundary to the westerly boundary. It was
relocated 50 feet from the centerline of the drainage swa1e located on Lot 26, Lands of
Brozosky. Staff has since discovered that the V ACSP and the EIR restrict construction from
occurring within 100 feet of the centerline of Jurisdictional Waters of the U.S. of which this
ephemeral drainageway is. The lots have been revised to stay out of this setback area, however,
staff proposes supporting the location in the road in that the access road will align with the

Page - 21
