(SR 96: 87)

Brian Swift presented the staff report.

Mr. Tarver asked if staff had considered making uses conditional instead of permitted7

Mr. Swift indicated permitted uses would still have to comply with the existing
conditions. The neighbors have indicated they are not interested in a lot of conditional use
procedures; they do not want to have to keep coming to Planning Commission hearings to
protect their interests.

Ms. Mohr asked if there were many cars from 6:00 to 6:30 a.m.9.

Mr. Swift believed there were just a few cars.

Mayor Tarver declared the public hearing open.

Thomas Cave, 150 Almaden Blvd., Suite 1375, San Jose, representing Manulife Real
Estate, indicated the new owner has tried to accommodate the homeowners as much as it can.
He had four items to discuss: the light standard, gate hours, building uses, and landscape and
lattice work on the fence. The light standard will take the place of low bollards in the center
of the parking lot because of the difficulty in installing the low beilards. There will still be
bollard lighting around the perimeter and at the rear near the homes. The problem of turning
the light off at 7:30 p.m. makes it almost worthless. In summer, it would never be turned on
and in the winter it would be used only about two hours. The parking lot is open to pedestrians
until 9:00 p.m. and the owners are concerned about lighting this area until 9:00 p.m. There
have been numerous studies to make certain this style lighting has minimal impact. Manulife
supports the request of La Petite Academy to have the gate open at 6:00 a.m. The Planning
Commission changed the hours to 6:00 a.m. to 7:00 p.m. The 7:00 p.m. closing time is
unjus~fied because there has never been a complaint during that time period. With respect to
the building uses, changing Building 5 to office only will seriously impact the economics of the
center and current tenants. The owner can accept the limited uses on Exhibit D and believes
those uses will not impact the homeowners.

He continued, Manulife agreed to install the latticework because of the concern that the
new landscaping would take a couple of years to grow high enough to block the Center. That
is an expensive proposition. However, there is a concern that the residents want fully mature

03/19/96 -15-
