Mayor Tarver declared the public hearing open.

Peter Shutts, 4133 Mohr Avenue, Suite G, appeared on behalf of the property owners.
Five years ago, when the owners were trying to get the project approved at 70 rooms, they
agreed to install a soundwall in an attempt to appease the neighbors and gain their support for
the project. There was no other issue that they felt the soundwall would address. Presently,
there is no need for sound mitigation for this project. They are improving the street and feei
that will mitigate any impacts. He indicated that if the project is required to build a soundwall,
the project will not proceed, because it cannot afford it. It is marginal now in its downsized
scale. He adamantly believed there was no need for the soundwall. In response to a question
from Ms. Dennis, Mr. Shutts described where the proposed soundwall would be located, which
is on the opposite side of the street from the project and extends farther on both sides than the
property line of the proposed project.

Gwynne Bandall, 4117 Crisfield Lane, indicated she was not against this project now or
in the past. The residents of Crisfieid Lane had concerns about this project because of the
density of the project, noise, traffic and safety issues. The prior plan addressed all those
concerns by reducing occupancy from 90 to 70 and by the developer building a soundwall along
the homes backing up to Mohr. She feels the neighbors' concerns for the current plan are not
being addressed. The occupancy is increased from 70 to 82; tnffic concerns have not been
addressed and she cannot believe that with more residents, more staff and more deliveries, that
the traffic will decrease. She referred to the city's traffic baseline count which indicated traffic
on Mohr Avenue had increased by 26% in 1995. She indicated cars have gone through their
fences and there. have been seven accidents in a one block area in five years. When you
introduce normal traffic inW this area, it will only make matters worse. She also objected to
parking on the street. She then complained about the sound this facility will generate from
traffic, ambulances, truck traffic for deliveries, etc. She felt sound studies should be conducted
in the summer and indicated a concern for the speeding cars on Mohr. If the developer is not
required to build a soundwall, she urged the city to include it in its capital improvement projects.

Dave Sharp, 4145 Cris~eld Lane, indicated he lives directly behind the proposed facility.
He supported the need for this facility and believed the reduced building size will blend with the
neighborhood better then the previously appwved two-story facility. He felt the south side was
being neglected by the developer. A curb and gutter only (no sidewalk) is not sufficient and he
wanted a soundwall installed. He pointed out that page 13 of the staff report was incorrect. The
improvements to Mohr Avenue were made in 1989, not 1991. If noise levels exceed city
standards in 1990 and no road impwvements have been made since then, he did not believe
traffic or noise levels had decreased. He feels both have increased over the years. He also
believed the traffic counts are taken at a point which misses many cars that turn off onto Koln
to miss the Santa Rita traffic light. He also raised questions about the TJKM report and related
a conversation he had with Chris Kinzel. His last point concerned the safety of the residents and
-- he related the history of traffic accidents.

03/19/96 -21-
