Mr. Swirl said if the appeal is denied it would direct staff to work with the developer to
come up with a plan that is acceptable. If the plan changes significantly it would have to go back
through the Planning Commission process.

Mr. Pico understood the Planning Commission asked the developer once to go back and
work with the neighborhood. He felt that New Cities did not do this before, so what would they do
different if this item is continued.

Ms. Michelotti would like to know how changes would effect the financing plan or if there
is any interest in redesigning the plan.

Mayor Tarvet made a motion to deny the appeal (Case PUD 97-12) and direct staff to
initiate conversations between the applicant and neighborhoods as it relates to the neighbor's
plan in order to develop a consensus plan.

There was no second.

Ms. Seto said if a plan has previously been reviewed by the Planning Commission and the
Council suggests modifications which can be worked out among all parties involved, the modified
plan can come back before the City Council. If the City Council denies the appeal, any changes to
the plan would have to go before the Planning Commission.

Mayor Tarver wanted the neighbors' concerns addressed without having it go back before
the Planning Commission.

Mr. Pico asked if the appeal could be denied and the neighborhood plan adopted.

Ms. Acosta said the neighborhood plan needs to looked at. The Council has denied appeals
without prejudice, sending the plans back to be worked on. She said without a plan it is hard to
determine whether it would need to go before the Planning Commission.

Mr. Swift said in order to keep this application alive it would need to be continued and
direct staff to evaluate the neighborhood plan with the applicant and neighbors.

Mr. Pico asked the question again, what is different now than when the Planning
Commission denied the application because the applicant failed to work with the neighbors.

Mr. Swift said the difference is the City Council directing the applicant to work out an
acceptable plan rather than the Planning Commission.

Ms. Ayala asked if a development agreement would be brought back with the revised plan.
Ms. Acosta said yes.

Pleasanton City Council 11 08/09/99
Minutes
