222

wanted the repeal of Kottinger Hills on the ballot but subject to
a certification of signatures within 30 days ....

Mr. Roush felt uncomfortable with that procedure because it
was not authorized by the Elections Code. He was not saying that
it would absolutely not be upheld if challenged in court. He
believed such procedure would put the petitioners at some risk.

It was moved by Ms. Scribner, and seconded by Ms. Mohr, to
allow the process to continue.

The roll call vote was as follows:
AYES: Councilmembers Mohr, Scribner and Mayor Tarver
NOES: Councilmember Pico
ABSENT: None
ABSTAIN: None

Council recessed at 10:08 p.m. for a break.

Council reconvened at 10:15 p.m.

Item 12d
Item 4e
Approve the subdivision aqreement, final map, and improvement plans
for Tract 6362, earms Ranch, A-M Homes; and authorize the City
Manaqer to execute the subdivision agreement for this development.
(SR92:483)

Mr. Pico believed that A-M Homes had given a verbal commitment
that it would not record the lot line adjustment until such time
that a water diversion agreement entered into between Mr. Joel and
Ms. Sorensen. He believed that A-M Homes violated that commitment.
He was not sure what he was being expected to vote on. He pointed
out that there was no final map attached to the staff report. He
had not have the opportunity to talk to staff to get additional
information. He was concerned with Recommendation 3 (authorizing
the City Manager to execute the Subdivision Agreement) and
Paragraph 7e (security) of the Agreement. This is a project that
is being developed in a very steep terrain.

Mr. Pico understood that there was some question as to the
geology of this area as well. He questioned the one year time
period being a reasonable time period to be asking for a
maintenance bond. He asked that this item be continued to the
December 15, 1992 City Council meeting.

Mayor Tarver did not intend to approve the final map on this
project. He was not sure what the outcome would be if Mr. Pico did
not find agreement with the two final maps.

12/1/92 20
