223 Mr. Roush explained that staff has indicated that the developer has met all of the requirements of the Subdivision Map Act and all of the conditions of approval; therefore, if the Council at this meeting or the next meeting fails to approval or disapprove the map it would be deemed approved. Mayor Tarver asked staff if this would mean that there will be a subdivision agreement if Council failed to approve the final map. Mr. Roush explained that the Subdivision Map Act provides that in order to approve the final map, the bonds and subdivision agreement would need to in place. The subdivision agreement would also be deemed approved, but the terms of the agreement could be considered separately. Ms. Mohr asked that staff report back to Council what Council's authority is to approve or disapprove final maps. It was moved by Ms. Scribner, and seconded by Mr. Pico, to continue Items 12d (4e) and 12e (4f) to the December 15, 1992 City Council meeting to allow time for Mr. Pico to meet with staff regarding his concerns. Item 12f Item 4q Accept the public improvements for Tract 5875, Kottinger Ranch Unit II, Westbrook Housing Group, and authorize the City Clerk to file a Notice of Completion. (SR92:489) Mr. Pico stated that he had previously spoken with staff regarding this issue and was concerned whether the Lin organization had provided certain written assurances and whether or not such assurance were related to the Kottinger Hills referendum.
