224

It was moved by Ms. Scribner, and seconded by Ms. Mohr, to
accept the public improvements for Tract 5875, Kottinger Ranch Unit
II, Westbrook Housing Group, and authorize the City Clerk to file
a Notice of Completion.

The roll call vote was as follows:
AYES: Councilmembers Mohr, Pico, Scribner and Mayor Tarver
NOES: None
ABSENT: None
ABSTAIN: None

Item 12q
Item 41
Extension of Subdivision Aqreement for Tract 6275, Equus Heiqhts,
Phase I, Equitrol, Inc. (SR92:482)

Mr. Pico asked staff to list the options that Council has with
regard to the extension.

Mayor Tarver asked what the reason was for the delay.

Mr. Elliott indicated that the reason for the delay was
because of the economy.

Mayor Tarver was concerned with giving automatic extensions.
He believed that there should be a procedure for applicants to
document the reasons for extensions. He suggested that staff
develop a criteria.

Ms. Mohr was not sure that staff could come up with a criteria
for justifying an extension because every project will be
different. Perhaps the applicant could provide an explanation to
accompany its request for an extension.

Mayor Tarver would like to be aware if projects were not
moving through the process for any reason. This would keep Council
aware of the status of projects.

Martin Inderbitzen, 5000 Hopyard Road, represented the Yees.
He stated that the Yees were willing to move forward on this
project. As stated in the letter sent to Council from the Yees,
the delay was because of the economy and extended negotiations with
utility companies. He stated that notwithstanding the execution of
the subdivision agreement last year, the actual improvement plans
just got approved by the Public Works Department in September 1992.

Mr. Pico believed that this project should have the Foothill
Overlay District requirements applied to it. He felt that the
approval was a bad decision by the former Council and the project
should be revisited. He was not aware of any significant change in
the economic situation from the way it was 12 months ago.

12/1/92 22
