90

11. LEGISLATIVE UPDATE REPORTS

There was no report on this item.

12. REPORTS OF THE CITY MANAGER
12a
Acceptance of Offer of Dedication of Parcels A, B, C & D-Tract 4768

Mr. Roush suggested, in light of the discussion regarding late
materials for items on the agenda, that if it were possible to get
assurance from those in the audience that no further work would
take place on these parcels until this matter can be discussed as
a regular agenda item, then nothing has to be done on this matter
tonight.

Mr. Steve Davis, 16 Dolores Way, Orinda, stated that he is the
owner of Parcel C in Tract 4768. The Foothill Knolls development
is on the northside of Foothill Road and when that development was
being reviewed and finally approved by the City, there was no
definite plan for Foothill Road. One of the conditions of approval
of that development was that the developer will make an offer of
dedication for Foothill Road right-of-way to accommodate four
travel lanes, with the intent that in the future Foothill Road
would be widened in that area. Since that time there has been a
great deal of study and planning put into developing the alignment
of Foothill Road. Just recently Council approved an alignment
study and in the area adjacent to the subject property, Foothill
Road is proposed to be a two lane road with a center turn lane and
the road is proposed to be shifted southerly from its current
alignment. What that would do would be to create some space
between the edge of the pavement and the edge of the proposed bike
path and current right-of-way line for Foothill Road. He has some
interest in a 30 foot wide parcel adjacent to the existing right-
of-way and based on previous actions he can see no present need for
the parcel he owns to be accepted as a right-of-way. Based on the
recent alignment study, he can see no reason in the future for this
property to be required for roadway purposes. Since July of this
year he has been corresponding with Staff discussing the issue and
he believes staff has shown no indication that there was any intent
on the part of the City to accept these dedications.

Mayor Mercer asked Mr. Davis what he intended to do with the
property.

10-15-91 26
