91

Mr. Davis responded that he had no specific plans at the
moment. It's a narrow parcel and it would be very restrictive to
do anything on that property. Right now it's an asset. Without a
definite plan for Foothill Road that requires this property he sees
no reason for the Council to act at this time to accept the
dedication. What he intended to do was to put a fence up to define
the boundaries and to protect his liability. There is a slope on
portions of the lot and feels that if he doesn't have some kind of
barrier up that he could be held liable for some damages there. In
1982 when the subdivision was approved, the City Council
specifically denied the offers of dedication. From that time to
now nothing has changed in the alignment of the roadway.

Mr. Roush responded that it is necessary to get zoning
approval to put up a fence.

Mr. Mercer suggested that Mr. Davis get together with Staff to
go over the fence issue and liability question.

Mr. Davis feels he has acted in good faith. When he received
the "stop notice" he complied and left the job site. He has no
problem with continuing this item until the next council meeting as
long as he gets the information from Staff in regards to the
matter.

12b (Moved from 4h on Consent Calendar)
Approve the a~reement with Luhdorff and Scalmanini, Consulting
Engineers for Engineering and Inspections Services on the new Joint
City of Pleasanton/Dublin San Ramon Services District Water
Production Well. (SR 91:439)

Mr. Elliott responded to Mr. Cordtz's first question by
indicating the Scope of Work was attached to the Request for
Proposal and will be added to the contract.

Mayor Mercer commented that what Staff presented in the staff
report was adequate. He puts his confidence in Staff's
recommendations which have generally been beyond reproach. He
recommends that, in the future, Mr. Cordtz get his information from
Staff prior to the City Council meetings. Staff is the proper
source for getting the details he is requesting.

Mr. Elliott then responded to the question regarding the award
of construction studies. He firmly believes that there have been
all the necessary talks and negotiations with Dublin and Zone 7 and
that we are prepared to proceed at this juncture.

In regards to how this well will effect the annual pumping
capabilities, Mr. Elliott responded that during the drought Zone 7
suspended the independent quota. If that situation were to repeat
itself, Zone 7 would do so again. Zone 7 had encouraged the City
to pump as much as possible as Zone 7 could not supply what was needed.

10-15-91 27
