Mr. Pico indicated he would not sign any ballot argument, for or against. The
remaining Councilmembers agreed.

It was moved by Mr. Pico, seconded by Ms. Ayala, to direct staff to notify the
Regional Water Quality Control Board and Zone 7 of the fact that this action has
been taken, that the measure will be on the ballot in March, and ask that they delay
any decision on this issue until we get the election results.

The roll call vote was as follows:
AYES: Councilmembers - Ayala, Dennis, Michelotti, Pico, and Mayor Tarver
NOES: None
ABSENT: None
ABSTAIN: None

Mr. Roush indicated the ballot arguments are due December 17, 1999 and the
rebuttal arguments will be due December 27, 1999.

Item 6e
Status Report on the Livermore Amador Valley Water Management Agency
(LAVWMA) Financing Plan for the Export Pipeline Project (SR 99:351)

Mayor Tarver indicated he would have to leave the meeting, but wanted to
comment on the LAVWMA agreement. He and Mr. Pico have been working with the
DSRSD Liaison group and support the report and the next step in the financing plan of
the LAVWMA project. He wanted to dispel any potential rumors that they are causing a
problem in getting this done.

It was moved by Mr. Tarver, seconded by Mr. Pico, to approve the tentative
agreement and process for completing the LAVWMA financial plan described in
the Liaison Committee Meeting Agenda dated November 30, 1999.

Mayor Tarver left the meeting at 11:20 p.m.

Mr. Lum presented the staff report.

Mr. Pico indicated this has been reviewed with representatives from DSRSD and
with City staff and he believed that the level of risk to the Pleasanton ratepayers has been
reduced significantly and in the spirit of Measure U, we should proceed expeditiously to
get the expansion project under way. The final agreements will come back for approval,
but the project will proceed as expeditiously as possible.

Peter MacDonald, 400 Main Street, supported Mr. Pico's comments. The
tentative agreement represents the details upon which the final agreement can be worked
out. In the spirit of Measure U, Council should approve this and we should move on.

Pleasanton City Council 21 12/07/99
Minutes
