It was moved by Mr. Brozosky, seconded by Ms. Ayala, to modify the fence
to require an overlapping sound-attenuating barrier to block the wall(way to deter
bicyclists and protect the safety of pedestrians while maintaining the pedestrian
walkway.

The roll call vote was taken as follows:
AYES: Councilmembers - Ayala, Brozosky, Campbell, Hosterman,
Mayor Pico
NOES: None
ABSENT: None
ABSTAIN: None

and

It was moved by Mr. Brozosky, seconded by Mr. Campbell, to retain the
existing hours of 6:00 a.m. through 12:00 midnight for the Jack-In-The-Box drive-
through, and to reduce the hours to 8:00 a.m. through 9:00 p.m., Monday through
Sunday for the carwash.

The roll call vote was taken as follows:
AYES: Councilmembers - Ayala, Brozosky, Campbell, Hosterman, and
Mayor Pico
NOES: None
ABSENT: None
ABSTAIN: None

Mr. Brozosky asked staff if the lights over the carwash entrance needed to
remain for safety reasons, and if the glare from the lights was a problem.

Mr. Swift pointed out that the lights over the carwash entrance turn off at 9:00
p.m. He believed having the lights over the carwash entrance was useful. He noted that
the lights at the back of the buildings have been modified. The lights are visible to the
neighborhood depending upon which house and which room someone is in. From the
second story, the lights will be visible above the wall. He did not believe it would be a
major issue as these lights turn off at 9:00 p.m. The Planning Commission required the
lights over the carwash entrance to be removed along with the signs. He said that it was
not clear whether the neighbors were opposed to the lights and signs or just the sign that
was lit.

It was moved by Mr. Brozosky, seconded by Mr. Campbell, to retain the
lights over the carwash entrance with a 9:00 p.m. turn off time.

Ms. Hosterman said she had an issue with the lights. The street light entrance
was acceptable because it is directed downward. The lights on the sides of the buildings
are very apparent the further one moves away from the building and radiates a
significant amount of glare. She believed the property owners were looking into using
frosted light bulbs, If the lights and monument signs are unacceptable and over time
they become a continuing problem, Council will have an opportunity to address this
issue in the future.

Mr. Brozosky suggested moving the lights lower to avoid reflecting a glare, which
would still allow for adequate lighting below.

Pleasanton City Council 25 09/07/04
Minutes
