• •
service Parcel 1, for the purpose of reasonable maintenance, repair
and replacement. Bundolo further reserves the right to establish,
for the benefit and appurtenant to Parcel 2, a non-exclusive
easement for access to all sewer, water, electrical, gas, telephone
and other utility services and lines located on Parcel 1 including
without limitation all transformers and meters, which service
Parcel 2 for the purpose of reasonable maintenance, repair and
replacement. Bundolo further reserves the right to convey, as part
of such easements, the right to take all actions reasonably
necessary or appropriate to effect such maintenance, repair or
replacement, including without limitation the right to excavate.
2.2 Notice; Reasonable Access. Each utility easement
provided for above shall include the requirement that the holder of
the easement rights (the "Dominant Tenement Holder") give
reasonable written notice to the owner of the property subject to
such easement rights (the "Servient Tenement Holder") of the
proposed entry setting forth the nature of the work, if any, to be
performed. Notwithstanding the foregoing, no notice shall be
required in the event of an emergency. No entry into any
building located on the property of the Servient Tenement Holder
shall be made by the Dominant Tenement Holder unless the necessity
for such entry is set forth in the notice referenced above, and
then only at such time as is reasonably acceptable to the Servient
Tenement Holder.
- 3 -
