• • <br />2.3 Costs. The utility easements referenced above shall <br />further provide that all costs and expenses incurred in connection <br />with the maintenance, repair and replacement of .any utility line, <br />system or equipment, including electrical transformers, that <br />benefit both Parcel 1 and Parcel 2 shall, except as otherwise <br />mutually agreed, be paid 63.19 percent by the owner of Parcel 1 and <br />36.81 percent by the owner of Parcel. 2. All costs and expenses <br />incurred in connection with the maintenance, repair and replacement. <br />of any utility line, system or service including without limitation <br />any transformers, that benefit only Parcel 1 or only Parcel 2 shall <br />be borne solely by the owner of the Parcel so benefitted. <br />(3) LANDSCAPING. Bundolo further reserves the right to <br />designate the holder of Parcel 1 as the manager with respect to the <br />maintenance of all landscaping located on both Parcel 1 and Parcel <br />2 with the following rights and responsibilities. Such manager <br />shall be the contact person for the benefit of the City of <br />Pleasanton, California and such other persons as may be appropriate <br />from time to time in connection with such landscaping. Such <br />manager shall be responsible for the acquisition. of any bids for <br />landscaping services, and for seeking the consent of the owner of <br />Parcel 2 to the selection of the landscape maintenance company from <br />time to time and to any additions or modifications to the <br />landscaping which are not a part of the normal maintenance program. <br />It is intended that the landscaping on Parcel 1 and Parcel 2 be <br />maintained in substantially the same condition and quality as <br />exists as of the date of this Reservation.
