3.3.4 Disturbance to Active Raptor and Other Protected Birds' Nests
Potential Impacts. Although no stick nests were observed during either of the 2008 surveys,
trees around the periphery of the property provide suitable nesting habitat for red-tailed hawks,
white-tail kites, loggerhead shrikes, and other protected tree-nesting, avian species. The
proximity of these trees to the project site suggests that if any of these birds were to nest in trees
in the future, prior to development of individual pazcels, such project-related activities could
result in the abandonment of active nests or direct mortality to these birds. Construction
activities that adversely affect the nesting success of raptors and other protected birds or result in
mortality of individuals of these birds constitute a violation of state and federal laws (see Section
3.2.3) and would be considered a significant impact under CEQA.
.Mitigation. For development-related activities that would occur within 250 feet of suitably
sized trees during the breeding season (February 1 through August 31), a qualified biologist
should conduct apre-construction survey for tree-nesting raptors and loggerhead shrikes in all
trees on the project site (and within 250 feet of the site) within 30 days of the onset of site
disturbance. If nesting raptors or loggerhead shrikes are detected adjacent to the site during the
survey, a suitable construction-free buffer should be established around all active nests. The
precise dimension of the buffers (usually 250 feet) would be determined at that time and may
vary depending on location and species. The buffer areas should be enclosed with temporary
fencing, and construction equipment and workers should not enter the enclosed setback azeas.
Buffers should remain in place for the duration of the breeding season or until it has been
confirmed by a qualified biologist that all chicks have fledged and are independent of their
parents. Pre-construction surveys during the non-breeding season are not necessary for tree-
nesting raptors or loggerhead shrikes, as they aze expected to abandon their roosts during
construction. Implementation of the above measures would mitigate impacts to tree-nesting
raptors and loggerhead shrikes to aless-than-significant level.
3.3.5 Loss of Habitat for Native Wildlife
Potential Impacts. While a number of native species may use the site for foraging and
breeding, most of these species are widespread in the remaining open space that occurs in the
vicinity of Pleasanton.
